West Virginia has no service dog certification, and its own law says a service animal "is not required to be licensed or certified by a state or local government" for access. Separately, guide and support dogs must be registered as dogs through the county, with the head tax waived. Faking a service animal is a misdemeanor: up to $200 and 10 days in jail, or up to $1,000 and 30 days for a repeat.
Who counts as a service animal in West Virginia?
W. Va. Code 5-15-3(c): "A 'service animal' means any guide dog, signal dog or other animal individually trained to do work or perform tasks for the benefit of an individual with a disability". That is broader than the ADA, because it is not limited to dogs and miniature horses. Emotional support animals are not covered, because training is required.

Public places in West Virginia, including hotels and restaurants
W. Va. Code 5-15-4(c) gives the right to be accompanied by a service animal in public places, including hotels and restaurants, with no extra charge; the handler is liable for damage unless the animal was provoked, and on common carriers the animal may not occupy a seat and must be leashed. Section 5-15-4(e) adds that a service animal "is not required to be licensed or certified by a state or local government, nor shall there be any requirement for the specific signage or labeling". Denying access is a misdemeanor with a fine "not to exceed $50" (5-15-8).
Under the ADA, if it is not obvious what your dog does, staff may ask only two things: is the dog required because of a disability, and what work or task has it been trained to perform. They may not ask for papers, ask about your disability or ask for a demonstration. See what businesses can ask.
Service dogs in training in West Virginia
Yes, with a condition. Section 5-15-4(d) says the rights "also apply to any person who is certified as a trainer of a service animal while he or she is engaged in the training." The code does not define "certified" or say who certifies, so an owner-trainer's status is unclear.
Federal law does not fill the gap. The DOJ says that under the ADA "the dog must already be trained before it can be taken into public places." State law is the only source of access for a dog in training. See service dogs in training for what to work on first.
Is there a West Virginia service dog registration or tag?
This one needs an honest explanation, because it is easy to misread. W. Va. Code 19-20-2 exempts "any guide or support dog especially trained" for a blind, deaf or physically or mentally disabled person from the county dog head tax, and says "Guide or support dogs must be registered as provided by this section". That registration is the ordinary county assessor dog registration, with its certificate and tag, just without the tax.
It is not a service dog certification, and it is not a condition of access: 5-15-4(e), quoted above, says access cannot depend on a state or local license or certification. A private registry card, including ours, is not this county registration and cannot replace it.
Under the ADA, mandatory registration of service dogs is not allowed, and the DOJ says registration documents sold online "do not convey any rights under the ADA". That includes our voluntary registry, which is for practical things like an emergency contact and a lost-dog tag, not access.
Housing: service dogs and ESAs in West Virginia
We found no West Virginia statute specific to emotional support animals or assistance animal documentation in rentals, so housing requests rest mainly on the federal Fair Housing Act.
The federal picture changed in 2026. The Fair Housing Act still requires reasonable accommodations, but on May 22, 2026 HUD permanently rescinded its 2020 assistance animal notice and said its fair housing office will find reasonable cause in animal cases only where the animal is individually trained. That is an enforcement policy, not a change to the statute; private lawsuits remain available, and West Virginia law is unaffected. See ESA letters for housing after HUD's 2026 change.

Employment in West Virginia
The public-access rules do not govern the workplace. Bringing a service dog to work is a reasonable accommodation request under Title I of the ADA, worked out through an interactive process with your employer. Unlike a store, an employer may ask for reasonable documentation when the disability or the need is not obvious, and must consider the request but does not have to allow the dog automatically.

Misrepresentation penalties in West Virginia
West Virginia added its rule in 2018 (SB 397):
"(b) Any person who falsely represents that an animal is a service animal in order to obtain any right or privilege protected by the provisions of ยง5-15-4 of this code is guilty of a misdemeanor and, upon conviction, shall be fined not more than $200 or confined in jail for not more than 10 days, or both".W. Va. Code 5-15-9
A second or later violation is punished by "not more than $1,000 or confined in jail for not more than 30 days, or both" (5-15-9(c)). Some summaries list only the first-offense penalty. Subsection (a) separately punishes falsely claiming to be blind or disabled.

Where to file a complaint in West Virginia
- Businesses and public places: file an ADA complaint with the Department of Justice through ADA.gov.
- Housing: report housing discrimination to HUD. Since the 2026 memo HUD pursues animal cases only where the animal is trained, but a private lawsuit is still an option.
- Work: file a charge with the EEOC.
Denying access is a misdemeanor under W. Va. Code 5-15-8, so it can also be reported to local police.
