Illinois has several overlapping definitions. Its Criminal Code covers dogs and miniature horses trained or being trained, including psychiatric and autism service animals. Trainers of support, guide, seizure-alert, seizure-response and hearing dogs have access with dogs in training. Illinois has no fake service dog law and no ESA housing statute.
Who counts as a service animal in Illinois?
The Criminal Code's access section (720 ILCS 5/48-8) defines a service animal as "a dog or miniature horse trained or being trained as a hearing animal, a guide animal, an assistance animal, a seizure alert animal, a mobility animal, a psychiatric service animal, an autism service animal, or an animal trained for any other physical, mental, or intellectual disability," with ADA-style factors for miniature horses (size, control, housebroken, safety).
Other laws use other words. The Humane Care for Animals Act says "an animal trained in obedience and task skills to meet the needs of a person with a disability." The White Cane Law uses "support dog", "guide dog", "seizure-alert dog", "seizure-response dog" and "hearing dog". The federal ADA definition applies alongside all of them.
Public places in Illinois, including hotels and restaurants
Two laws protect access. The White Cane Law lets blind, visually or hearing impaired people, people with seizure disorders and people with "any other physical disability" bring a support or guide dog "without being required to pay an extra charge"; denial or interference is a Class A misdemeanor (775 ILCS 30/3, 30/4).
The Criminal Code separately says a person with "a physical, mental, or intellectual disability requiring the use of a service animal" and the animal "shall not be denied the right of entry and use of facilities of any public place of accommodation"; a knowing violation is a Class C misdemeanor (720 ILCS 5/48-8).
The federal ADA applies in Illinois too. When it is not obvious what the dog does, staff may ask only whether it is a service animal required because of a disability and what task it has been trained to perform. Service dogs in training in Illinois
Yes, for trainers. "A trainer of support dogs, guide dogs, seizure-alert dogs, seizure-response dogs, or hearing dogs shall have the right to be accompanied by ... a dog that is being trained" for that work, without extra charge, and is liable for damage (775 ILCS 30/3). The Criminal Code also covers "a trainer of a service animal" and an animal "trained or being trained". "Trainer" is not defined, and no certification, school or ID requirement appears in the text. Is there a Illinois service dog registration or tag?
No. Illinois has no state service dog ID or registry. County animal control boards set registration fees, and the state section on those fees has no service dog exemption, so any waiver is local.
A private registration, including our voluntary registry, is optional and adds no rights.
Housing: service dogs and ESAs in Illinois
Illinois has no ESA housing statute. The Illinois Human Rights Act makes it a civil rights violation "to refuse to make reasonable accommodations in rules, policies, practices, or services" needed for a person with a disability to use a dwelling (775 ILCS 5/3-102.1), with no animal-specific or documentation rules. The Assistance Animal Damages Act (740 ILCS 13) gives civil damages for harm to an assistance animal trained to help a physically impaired person.
Federal housing law shifted in 2026. HUD withdrew its 2020 assistance animal guidance, and a May 22, 2026 memo says its fair housing office will find reasonable cause in animal cases "only for those cases involving animals trained to provide disability-related assistance." ESA letters in Illinois
No Illinois statute sets rules for ESA letters: no relationship length, no license-number requirement, no penalty for letter writers. That leaves the general reasonable accommodation process under the Human Rights Act and the federal Fair Housing Act.

Employment in Illinois
Public-access rules do not govern the workplace. Employment falls under Title I of the ADA: you request an accommodation, and when the disability or need is not obvious your employer may ask for reasonable documentation, which a store may not. EEOC settlements show a trained service dog can be a reasonable accommodation. Put your request in writing. More in service dogs at work.
Misrepresentation penalties in Illinois
No Illinois statute penalizing misrepresentation of a service animal was found. Illinois does not appear on the Michigan State University list of states with fake service dog laws, and none turned up in the relevant chapters of the Illinois Compiled Statutes. That review did not search every 2024 to 2026 public act, so check the sources below for anything newer.

Where to file a complaint in Illinois
- A business, hotel, restaurant or government office refused your service dog: report it to the U.S. Department of Justice through the online form linked from its ADA complaint page.
- Housing: Fair Housing Act complaints go to HUD, which now finds cause in animal cases only for trained animals. A private lawsuit is still possible.
- Work: file a charge with the EEOC, generally within 180 calendar days, or 300 days where a state or local agency enforces a similar law.
- State route: refusing a reasonable accommodation in housing is a civil rights violation under the Illinois Human Rights Act. Denying a handler entry is a misdemeanor under the White Cane Law and the Criminal Code.
