No. Service dog vests are not required. The Department of Justice says: "The ADA does not require service animals to wear a vest, ID tag, or specific harness." A service dog without a vest has the same rights as one wearing a vest, and a pet in a vest has none of them. Vest colors mean nothing legally. Putting service dog gear on a dog that is not a service dog is the part the law cares about: at least 36 states penalize it in some form, and Missouri and Texas name the gear directly.
Required? No
The rule is in the DOJ's service animal FAQ, question 8: "No. The ADA does not require service animals to wear a vest, ID tag, or specific harness." The regulation itself, 28 CFR 36.302(c), lists what a business may and may not do, and requiring a vest is not among the things it may do. It may not require documentation "such as proof that the animal has been certified, trained, or licensed as a service animal."
What is required is control. The dog must have "a harness, leash, or other tether" unless your disability prevents it or it would get in the way of the dog's task, and it must be housebroken. A business may ask you to remove a dog that is out of control when you do not take effective action, or that is not housebroken. A missing vest is never a reason.
Does a vest stop staff from asking questions?
Not by itself. Staff may ask the two questions (is the dog required because of a disability, and what task is it trained to do) unless it is "readily apparent" that the dog is trained to do work for you. A vest is not what makes it apparent; what the dog is doing is. In practice a vest often means fewer questions, but it does not remove the right to ask. See what businesses can ask.
Do service dog vest colors mean anything?
Not legally. No federal law or regulation assigns a meaning to red, blue, yellow, green or any other color, and a service dog vest does not have to be red. Colors are a convention sellers use. At Do Not Pet we keep ours consistent (red for service dog, blue for emotional support, green for in training, yellow for do not pet) so the color never contradicts the words, but that is our labeling, not a rule anyone else has to follow. The words on the vest are what matter.
Can anyone buy a service dog vest?
Yes. There is no license to buy one, and sellers do not have to verify anything. That is the heart of the fake service dog problem, and it is why the vest proves nothing to anyone who knows the rules. There is no such thing as a "real" or "fake" vest; there are only true and false claims about the dog wearing it.
We ask buyers of our service dog gear to confirm at checkout that the dog is individually trained to do work or perform tasks for a person with a disability. For every other dog we sell gear that makes no claim: a Do Not Pet Vest, give-me-space patches or an in-training vest.
Can you put a service dog vest on any dog? The state laws
You can physically, but in many states you should not. At least 36 states penalize misrepresenting a pet as a service animal. Most laws describe the conduct generally; some name the gear.
Two states say it outright in their statutes. Missouri makes it a crime to be "Knowingly fitting a dog, if the dog is not a service dog, with a harness, collar, vest, or sign of the type commonly used by a person with a disability to indicate a dog is a service dog" (RSMo 209.204.2(3)): a class C misdemeanor (up to $750 and 15 days), and a class B misdemeanor for a second offense. Texas makes it a misdemeanor to use "a harness or leash of the type commonly used by persons with disabilities who use trained animals, in order to represent that his or her animal is a specially trained service animal when training has not in fact been provided" (fine up to $300 plus community service, as summarized by Michigan State University's state law table).
Elsewhere, the vest is evidence of the claim. Nevada makes fraudulently misrepresenting an animal as a service animal or a service animal in training a misdemeanor with a fine of up to $500 (NRS 426.805). California's Penal Code 365.7 allows up to six months in jail and a $1,000 fine. Check your state in fake service dog laws.
Can emotional support dogs wear service dog vests?
No. An emotional support animal is not a service animal under the ADA, so a "Service dog" vest on an ESA is a false claim, the exact thing the state laws above target. Some states go further in housing: Missouri's law also covers "fitting" a non-assistance animal with a vest or sign to get a housing accommodation, and Kentucky has a similar housing provision (KRS 383.085(6)(d)).
An ESA can wear an honest vest that says "Emotional support" or "Please ask first". It still does not get the animal into places that do not allow pets. See emotional support dog vests.
Why we still sell vests
Because a clear vest makes public life easier for a working team, even though the law does not require one. Handlers use them to cut down on strangers petting, calling to or feeding their dogs, and to signal "working" before anyone asks. Owners of nervous or recovering dogs use Do Not Pet vests for the same reason. We just refuse to pretend the vest does anything legal, and we say so on our vest product pages.
